Hopes of Hilary Duff and Mike Comrie getting back on each other’s arms were permanently dashed when the former Disney star officially files for divorce and requested for the primary physical custody of their son, Luca. Hilary ‘s decision is said to be influenced by reports of Mike drunk flirting with women in Beverly Hills on a wild night.

A rep for the “Lizzie McGuire” star has already filed for a divorce from her husband, Mike, Billboard reported. This came a year after they announced their separation. TMZ exclusively reported that what pushed Hilary to finally make the official move was Mike’s wild night in Beverly Hills. According to sources, Hilary’s decision to go ahead with the divorce had something to do with the Mail Online UK report that Mike spent a rowdy night drunk and flirting with women at Mastro’s steakhouse.

TMZ also reported that the “Come Clean” singer hired high-profile celebrity attorney Laura Wasser to represent her on the divorce proceedings. The singer actress also wants to gain primary physical custody of her son with Mike, who is turning three on March. Hilary wants the former NHL player to be granted visitation rights even though she is also said to be worried of how Mikey’s drinking and partying could affect Luca.

Many had hoped the two would still reconcile, since they acted like close friends and great parents for Luca while separated. They took family and hiking trips with their son and sometimes, Hilary and Mike could even be seen attending parties and doing things together. Hilary herself hinted at a possible reconciliation last year. "We love each other so much and we love spending time together," Duff told E News. "So when you see us out it's not just for Luca, it's because we make plans and we hang out and we don't know what our future looks like right now but we're both doing really good and just figuring out what makes us happy."
