Will Tuckey, his lawyer, sought a non-custodial or suspended sentence for Mr Holmwood, but the magistrate rejected the move because the New Zealander had a previous record and is considered a serial streaker based on his same act at the Warriors vs Tigers match at Leichhardt in Sydney's inner west in 2011.

The lawyer pointed out that Mr Holmwood is of limited intelligence and has complicated needs. Mr Tuckey added the media attention that the streaker got caused him to be publicly humiliated.

But the magistrate didn't buy the argument and said, "In the circumstances of totality, bearing in mind the breach of bond as well as the offence that constituted the breach of bond, I do come to that conclusion."

Mr Holmwood lodged an appeal.
