HealthKit, the newest inclusion on Apple's recently launch iOS 8, is also the name of a small Australian health software company.

"HealthKit is already in use, by us! Even the way they write it is the same as us. I'm flattered that they like our name so much and that it's a ringing endorsement for our market opportunity (which we already knew)," Lachlan Wheeler, CEO, wrote in HealthKit's Web site.

Apple Inc. had neglectfully used a name of a company already existing Down Under.

"Apple liked our HealthKit idea so much that they have used our name and launched a new product called HealthKit," Wheeler wrote.

Wheeler was shocked to be receiving emails early in the morning of June 3 asking if he had entered a secret deal with Apple that allowed usage of his company.

"So, today was interesting. I woke up at 4:30 am and turned to my Apple iPhone to check my emails. Someone had emailed me to ask whether Apple stomped all over your name or did we do a secret deal with them. Huh?! I got up and turned on my computer and checked our web stats, and discovered we had lots of people on the HealthKit site. A good thing, you'd think. No, not really," Wheeler wrote, displeased.

Wheeler saw it as a deliberate disregard from Apple as "a quick domain search would have only taken 5 seconds" to pull up his company's Web site - www.healthkit.com

"Would it have made any difference to them? Are they so big that they are above doing an ordinary Google search?"

Wheeler had already called the attention of Apple's CEO Tim Cook via Twitter handler @tim_cook.

"Feeling annoyed #Apple is using our #HealthKit name for their new health product! @tim_cook r u aware of this? @healthystartups #rockhealth," Wheeler posted.

HealthKit, the Australian company, connects all medical practitioner and patients from all over the world. Those who are searching for a credible practitioner will find the most extensive directory of practitioners in its Web site.

Members of HealthKit can track, manage and share records of their health information online - a platform too close to how Apple designed its HealthKit app.

Curiously, a quick check on iOS 8 Preview Web site will inform users that the actual app to be seen on their iPhones will just be called Health.

On June 2, Apple Inc released its iOS 8 SDK with HealthKit during its Worldwide Developers Conference.
